A Slip Between the Cup and the Lip: Dilemma of Women’s Inheritance Rights in Muslim Societies

Abstract


In antiquity women inherited nothing and even when she inherited, she has been treated like a minor. Right of inheritance given to women was considered as a form of social protection for her, but it is evident that this matter has always been denied and its acceptability remained minimal. This denial made women more vulnerable to societal and domestic violence. The major reason of depriving women from the right of inheritance was the prevention of the transfer of wealth from one family to another. Fundamental premise of the study was to highlight gender equality in inherited rights and its critical prevailing situation not only limited to human rights issues but to the extent of general practices and customary norms related to it.  Articulating a quantitative study on deprivation of women from rights of inheritance, this research focuses on the present situation of women in relation to inheritance rights, identification of the prevalent evidences of disparity for equal rights of inheritance, barriers of the women’s rights of inheritance, and its effects on women.  Study was conducted in southern Punjab, Pakistan. In the present study a sample of 100 women was selected through multistage sampling technique and data was collected through the help of interview schedule. The findings show that majority of the total respondents agreed that they do not have any idea about the actual share of their inheritance even though they were educated. Besides that they were of the opinion that society admits that they should be given share in the inherited property but the actual situation is adverse. In aggregate a significant majority of the respondents agreed that their parents consider dowry as substitute of their inherited right and being female they are bound not to deviate these customary practices. A vast majority admitted that their family always followed the Islamic law of inheritance, when asked why do not they claim their inherited right, answer was, they themselves give up their rights for disposition to kindness and compassion towards their brothers. In this way the plight of women in deprivation destined to continue until the reforms in, women awareness regarding their inherited rights, strengthening of law, and practices, are taken. It is to determine that what kind of inherited rights women own and to ensure that these rights are not lost through newly born customary practices and family based norms.
