Evaluating The Problem Of Implicit Compulsion In The Extortion

Abstract


The extortion in the crimes committed against the reliability and functioning of public administration is caused by abuse of influence. The individual's will, which provides unfair advantage to the public official, is not free in the extortion. The reason why the individual provides the benefit to the public official without his free will is the fear of losing what is right. The reason why the individual's will is not free is because the adjective of the public official puts pressure on the individual in order to obtain an unfair advantage. The pressure that seizes the will of the individual is expressed as compulsion in the criminal laws. There is not a certain form of compulsion causing pressure. Compulsion may be explicit or implicit.
