6769 Sayılı Sınai Mülkiyet Kanunu Çerçevesinde Endüstriyel Tasarımların Tescil Yolu İle Korunması

Özet

Ülkemizde 27 Haziran 1995 tarihli ve 554 sayılı Endüstriyel Tasarımların Korunması ile ilgili KhK ile başlayan tasarımların tescil yolu ile korunması, Kanun Hükmünde Kararnamenin yürürlüğe girmesinden 21 yıl sonra, 22.12.2016 tarihli 6769 Sayılı Sınai Mülkiyet Kanunu ile son halini alarak uygulamaya girmiştir. Bir endüstriyel tasarımın hukuki olarak korunabilmesi için tescil edilmesi, tescille korunabilmesi için de bir tanıma ve kanunla belirtilen şartlara uyması gerekmektedir. Kanun ile belirlenen “Tasarım”, “Ürün”, “Birleşik Ürün”, “Yenilik”, ”Ayırt edici Nitelik” gibi tanım ve kavramların irdeleneceği bu çalışmada, 6769 Sayılı Sınai Mülkiyet Kanunu çerçevesinde, değişiklik gösteren tanımlar ve tasarımların tescil şartları üzerinde durulacak ve daha önce yürürlükte olan 554 sayılı Endüstriyel Tasarımların Korunması ile ilgili KhK ile aralarında yer alan farklılıklar, tasarım meslek disiplini çerçevesinde ortaya konmaya çalışılacaktır.

Protection of Industrial Designs by Registration under Industrial Property Law No. 6769

Abstract

The protection of the designs by registration, which started on 27 June 1995 with Decree Law No.554 pertaining to the Protection of Industrial Designs, has been put into practice with the finalization of the Industrial Property Law No. 6769 dated 22.12.2016,  21 years after the Decree Law. In order for an industrial design to be legally protected, it is required to be registered, and for being registered, it is required to abide legal definitions and requirements. In this study, the definition and concepts such as "Design", "Product", "Complex Product", "Innovation", "Distinctive Character" determined by the Law will be examined and the definitions and registration terms of designs which has changed with the Industrial Property Law No. 6769 will be emphasized. The differences between them and the Decree Law No.554 pertaining to the Protection of Industrial Designs will be presented within the framework of professional design discipline.
