HUMAN RIGHTS AND MIGRATION POLICIES IN BRAZIL AND FRANCE: THEORETICAL AND POLITICAL PERSPECTIVES

Abstract


This paper aims to reflect on the theoretical and political perspectives on migration adopted by Brazil and France in the current context and its reflections on the guarantee of human rights. It is a participatory research, with a qualitative approach, linked to a cooperation project between Brazil and France. The study was carried out through the attendance of research meetings, also articulation between the Project “Vidas Paralelas Migrantes” (Parallel Lives – Migrants), different French, Brazilian universities, and organizations that work on the theme of migration, as well as the attendance of Workshops carried out with migrants in Brazil and in the France. In the French context, it is possible to observe that the measures have been mainly taken in order to increase the border control. Along with that, there are medical protocols that link the granting of refuge to the biological proof of trauma and, increasingly, the creation of Reception Centers for transitional housing for migrants who had their asylum application denied, revealing a logic of control, punishment and restriction of rights - aligned with economic liberalism. In the context of Brazil, the most recent action refers to the approval of the new migration law, whose construction began in previous governments, together with social movements, aligned with the guarantee of human rights. However, it should be pointed out that, although the theoretical and political perspectives present in the mentioned law indicate convergences with the view of human rights and the State of Social Protection, the current political scenario in Brazil signals opposite tendencies to the guarantee of these rights, allowing significant risks of setbacks.
