Geçmişten Günümüze Türk Hukukunda Kadının Hukuki Statüsü

Abstract

Özet

Türk hukuk tarihinde kadının statüsü geçmişten günümüze önemli değişikliklere uğramıştır. Eski Türklerde kadın gerek aile içinde gerekse devlet yönetiminde önemli bir yere sahip olmuştur. Osmanlı uygulamasında kadının hukuki statüsü büyük ölçüde İslam hukuku hükümlerine göre belirlenmiştir. Buna göre kadının evlilik birliği içerisinde hem mehri ve miras payı hem de bireysel olarak kazandıkları şahsi malvarlığına dâhildir. Kadının, nafaka ya da evi geçindirme yükümlüğü de bulunmamaktadır. Yine Tanzimat ve Cumhuriyet dönemlerinde önemli haklar elde eden Türk kadınının günümüzde ulusal, uluslararası birçok düzenleme ile koruma altına alındığı, birçok yasal güvence elde ettiği görülmektedir.

From Past to Present the Legal Status of Women in Turkish Law

Abstract

The status of women has undergone profound modifications from past to present. In the old Turks, women had a substantial role not only in terms of family but also at state government. Practice in the Ottoman state, the legal status of women was mostly determined in accordance with the terms of Islamic law. Accordingly, things that women acquire in marriage union through both pourparty, bridewealth and personal gain are included her personal wealth. Women do not have any alimony or maintain a family obligation as well. Similarly, it has been clearly seen that Turkish women have been put under protection and granted several legal guarantees by many national and international legal regulations at the present time, who acquired significant rights in Tanzimat Reform era and Republic period.
